Unistay Living — PG Management Platform

Please read these Terms and Conditions ("Terms") carefully before using the Unistay Living mobile application ("App") operated by Unistay Living ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Definitions

  • "App" refers to the Unistay Living mobile application available on Android and iOS.
  • "User" refers to any individual who downloads, installs, or uses the App, including PG owners, property managers, staff members, and tenants.
  • "Services" refers to all features and functionalities provided through the App and web dashboard, including property management, payment tracking, complaint management, notifications, reports, and analytics.
  • "Content" refers to all text, images, documents, data, and other materials uploaded, submitted, or generated through the App.

2. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

  • You must register an account using a valid phone number to access the App's features.
  • You are responsible for maintaining the confidentiality of your account credentials, including your password and any biometric authentication settings.
  • You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
  • You are solely responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Use of the App

4.1 Permitted Use

The App is intended for managing PG (Paying Guest) accommodations, including but not limited to:

  • Managing properties, rooms, and tenant information
  • Tracking rent payments, deposits, and financial records
  • Handling maintenance complaints and requests
  • Generating invoices, receipts, and reports
  • Sending and receiving notifications
  • Uploading and managing documents

4.2 Prohibited Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload false, misleading, or fraudulent information.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Interfere with or disrupt the App's servers, networks, or infrastructure.
  • Reverse engineer, decompile, or disassemble any part of the App.
  • Use the App to harass, abuse, or harm other users.
  • Scrape, mine, or extract data from the App using automated means.
  • Upload malicious software, viruses, or harmful code.

5. Roles and Responsibilities

5.1 PG Owners

  • Owners are responsible for the accuracy of property information, room configurations, and rent details entered into the App.
  • Owners must ensure that their use of the App complies with all applicable local laws, including tenancy and rental regulations.
  • Owners are responsible for managing their staff and manager access permissions.

5.2 Property Managers and Staff

  • Managers and staff must use the App only within the scope of access granted by the property owner.
  • Staff members are required to complete police verification as mandated by local regulations.

5.3 Tenants

  • Tenants are responsible for providing accurate personal information during onboarding.
  • Tenants must ensure timely rent payments as per their lease agreements.
  • Tenants should use the complaint system responsibly and in good faith.

6. Payments and Financial Information

  • The App facilitates payment tracking and record-keeping between PG owners and tenants. Unistay does not process, hold, or transfer any funds directly.
  • All financial transactions (rent payments, deposits, etc.) are conducted directly between the parties involved.
  • Payment records, UPI transaction IDs, and receipt information entered in the App are for record-keeping purposes only.
  • Unistay is not responsible for any payment disputes between owners and tenants.
  • Users are responsible for verifying the accuracy of all financial information entered into the App.

7. Content and Documents

  • You retain ownership of all Content you upload to the App, including photos, documents, and personal information.
  • By uploading Content, you grant Unistay a limited, non-exclusive license to store, process, and display such Content solely for the purpose of providing the Services.
  • You are responsible for ensuring that any Content you upload does not infringe on the intellectual property rights or privacy rights of any third party.
  • We reserve the right to remove any Content that violates these Terms or applicable laws.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

9. Notifications and Communications

  • By using the App, you consent to receive push notifications, including payment reminders, complaint updates, OTP codes, and service announcements.
  • You can manage notification preferences through your device settings.
  • We may send service-related communications that are necessary for the operation of the App, which cannot be opted out of.

10. Intellectual Property

  • The App, including its design, code, features, logos, and branding, is the intellectual property of Unistay and is protected by applicable copyright, trademark, and other intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.
  • You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

11. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • That the App will be uninterrupted, error-free, or secure.
  • That any defects will be corrected in a timely manner.

We do not guarantee the accuracy, completeness, or reliability of any information or Content available through the App.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Unistay Living shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, data, or business opportunities.
  • Damages arising from unauthorized access to or alteration of your data.
  • Damages resulting from any interruption or cessation of the App's services.
  • Any disputes between PG owners, managers, staff, and tenants.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Unistay Living, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the App.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Any Content you upload or submit through the App.
  • Any dispute between you and another User of the App.

14. Termination

  • We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms.
  • You may terminate your account at any time by contacting us.
  • Upon termination, your right to use the App will immediately cease.
  • Provisions of these Terms that by their nature should survive termination shall remain in effect, including Sections 10, 11, 12, 13, and 16.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the updated Terms within the App or by sending you a notification. The "Last Updated" date at the top indicates when these Terms were last revised. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Unistay regarding your use of the App and supersede all prior agreements and understandings.
